These Terms of Service set out the agreement between you and BetterBizLoans when you use our website, tools, and financing services. They explain who can use the service, what we do, what we do not promise, and the responsibilities each of us takes on. By using the site or submitting an inquiry, you agree to these Terms.

These Terms of Service (the "Terms") are a binding agreement between you and BetterBizLoans ("BetterBizLoans," "BBL," "we," "us," or "our") that governs your access to and use of our website, tools, content, and services (together, the "Service"). By accessing the Service, browsing the site, using any of our tools, or submitting an inquiry or application, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you are using the Service on behalf of a business or other organization, you accept these Terms on its behalf, and references to "you" include that business. If you do not agree with these Terms, please do not use the Service. We may post additional guidelines, notices, or terms for specific features. Eligibility
To use the Service and to submit an inquiry or application, you confirm that all of the following are true: you are at least 18 years old; you are accessing the Service for business purposes, not personal, family, or household purposes; and, if you are submitting information on behalf of a business, you are authorized to act for that business and to provide its information to us. You also confirm that the business operates in a U.S. state where we currently serve customers. We currently serve businesses in all 50 states. If your business is located outside of those states, we may not be able to assist you at this time, and any inquiry may not be processed. Eligibility to use the Service is separate from eligibility for any financing, which is always decided by underwriting and by the relevant financing provider.
Description of the Service
BetterBizLoans operates as a hybrid small-business financing company. We provide or arrange some financing directly, and we also operate as a marketplace that connects businesses with third-party financing providers. Through the Service, we provide educational information and tools, and we help you explore financing options, which may include working capital loans and business lines of credit (which are true loans); a merchant cash advance, which is a purchase of future receivables and is not a loan; invoice factoring, which is a true sale of receivables; SBA loans; and equipment financing. The specific products and providers available to you depend on your business, your information, underwriting, and provider availability, and not every product or provider will be offered to every business. The content and tools we provide are intended to help you make informed decisions, and they are not a substitute for professional advice. How we share the information you submit, and how we earn revenue, are described in the sections below and in more detail in our Privacy Policy and on our "How We Make Money" page.
Electronic Communications and Contact Consent
By using the Service, you agree that we may communicate with you electronically, including by email and through notices posted on the site, and you agree that electronic communications satisfy any legal requirement that a communication be in writing. When you submit an inquiry or application, you may be asked to check a consent box agreeing to be contacted by BetterBizLoans and by financing providers and partners about your request, including by phone, text message, and email, at the number and address you provide. That consent, where you give it, is described at the point of submission and in our Privacy Policy, and it is not a condition of any financing. Standard message and data rates may apply to text messages, and you can ask to stop receiving certain communications by following the instructions in those messages or by contacting us. We may still send you communications that relate to your active inquiry, application, or account, or that we are required by law to send.
No Guarantee of Approval, Funding, or Terms
Submitting an inquiry or application through the Service does not guarantee approval, funding, or any particular amount, rate, term, or other condition. Any indication, estimate, example, or tool output you see on the Service is for general informational purposes only and is not an offer, a commitment, or a promise of financing. All financing is subject to underwriting, verification of the information you provide, and approval by BetterBizLoans or by the relevant third-party financing provider, each of which applies its own criteria. A financing offer, if one is made, is created and presented separately, and the actual amount, pricing, fees, and terms will be set out in that offer and in the applicable agreement. We do not control, and cannot guarantee, whether any provider will make an offer or what that offer will contain. You should review any offer carefully and only proceed if its terms work for your business.

Your Responsibilities and Acceptable Use

You may not: use the Service for any unlawful, fraudulent, or harmful purpose; submit false, misleading, or unauthorized information, or impersonate any person or business; seek financing you do not intend to pursue; infringe the rights of others, including intellectual property and privacy rights; attempt to gain unauthorized access to the Service, other accounts, or our systems; introduce viruses or other harmful code; use automated tools to scrape, harvest, or collect data from the Service without our permission; or interfere with, disrupt, or place an unreasonable burden on the Service or the networks and servers behind it. We may, but are not obligated to, monitor use of the Service, and we may investigate and take appropriate action, including suspending or terminating access and reporting conduct to authorities, if we believe these Terms have been violated or that the Service is being misused.
Third-Party Financing Providers
Much of the financing available through the Service is provided by third-party financing providers and partners, and some financing may be provided or arranged directly by BetterBizLoans. Where financing is provided by a third party, that financing is governed by the provider's own application, agreement, disclosures, and terms, which form a separate relationship between you and that provider. Those provider terms, and not these Terms, control the financing itself, including its pricing, fees, repayment, and remedies. We do not control, and are not responsible for, the decisions, products, conduct, or agreements of third-party providers, and a provider's decision to make or decline an offer is its own. You should read any provider's terms in full before accepting an offer. Where BetterBizLoans provides or arranges financing directly, the applicable BBL agreement and disclosures will govern that financing.
Intellectual Property
The Service, including its design, text, graphics, logos, content, tools, and software, and all related intellectual property rights, is owned by BetterBizLoans or its licensors and is protected by U.S. and other intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal business purposes. You may not copy, reproduce, distribute, publish, modify, create derivative works from, reverse engineer, sell, lease, or otherwise commercially exploit any part of the Service or its content without our prior written permission, except as expressly allowed by these Terms or by applicable law. The "BetterBizLoans" name, logo, and related marks are our property, and other marks shown on the Service belong to their respective owners. We reserve all rights not expressly granted here.
Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERBIZLOANS DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or available at any particular time, that any content or tool output will be accurate, complete, or current, or that any inquiry will result in an offer or in financing. Any reliance you place on the Service is at your own risk. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERBIZLOANS AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. This includes, without limitation, damages arising from any decision by a financing provider, the terms of any financing, or the conduct of any third party. Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of certain damages, so some of these exclusions and limitations may not apply to you, and nothing in these Terms limits any liability or affects any rights that cannot be limited or waived under applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless BetterBizLoans and its officers, employees, and agents from and against any claims, demands, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: your use of the Service; your violation of these Terms; your violation of any law or the rights of any third party; or the information you submit through the Service, including any inaccurate, incomplete, or unauthorized information. We may, at our option, assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with us, and you will not settle any such matter without our prior written consent. This obligation does not apply to the extent a loss is caused by our own conduct where applicable law does not permit you to indemnify us for it.

We may also modify, suspend, or discontinue all or part of the Service, and we may suspend or end your access to the Service at any time if we believe you have violated these Terms or to protect the Service or others. The sections of these Terms that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnification, will continue to apply. These Terms, together with the Privacy Policy and any additional terms we post, are the entire agreement between you and BetterBizLoans regarding the Service. If any provision is found to be unenforceable, the remaining provisions will stay in full force, and the unenforceable provision will be applied to the maximum extent permitted by law. Our failure to enforce any provision is not a waiver of it. You may not assign or transfer these Terms without our prior written consent, and we may assign them in connection with a merger, acquisition, reorganization, or sale of assets. No. Submitting an inquiry or application does not guarantee approval, funding, or any particular amount, rate, or terms. Everything is subject to underwriting, verification of your information, and approval by BetterBizLoans or the relevant financing provider. If an offer is made, its actual terms are set out in that offer and the applicable agreement, which you can review before deciding whether to proceed.
Is a merchant cash advance a loan?
No. A merchant cash advance is a purchase of future receivables, not a loan. It works differently from a loan and is governed by its own agreement. We offer it alongside true loan products such as working capital loans and business lines of credit, as well as invoice factoring (a true sale of receivables), SBA loans, and equipment financing, so you can compare the options that may fit your business.
Who can use the Service?
You must be at least 18 years old, use the Service for business purposes, and, if you are submitting information for a business, be authorized to act on its behalf. We currently serve businesses in all 50 states. If your business is outside those states, we may not be able to assist you at this time.
What happens to the information I submit?
When you submit an inquiry or application, you authorize us to share the business and contact information you provide with financing providers and partners so they can review your request and prepare and present offers. We explain this in our Privacy Policy and on our How We Make Money page. You are responsible for providing accurate information and for only submitting information you are authorized to share.
Will I be contacted after I submit an inquiry?
Yes. When you submit an inquiry, you may be asked to check a consent box agreeing to be contacted by BetterBizLoans and by financing providers and partners about your request, including by phone, text, and email, at the contact details you provide. That consent is not a condition of any financing, standard message and data rates may apply to texts, and you can ask to stop certain communications. We explain this in our Privacy Policy.
